Legal Requirement for Landlords in England

All private landlords must have a valid EICR for every tenanted property, renewed at least every 5 years. Failure to comply with a remedial notice can result in fines of up to £30,000 per property.

The Electrical Safety Standards in the Private Rented Sector (England) Regulations 2020 impose clear, specific duties on private landlords:

  • Have the electrical installation inspected and tested by a qualified person at least every 5 years
  • Obtain a report (the EICR) from that inspection
  • Retain a copy of the EICR for at least 2 years
  • Provide a copy to the tenant within 28 days of the inspection
  • Provide a copy to new tenants before they occupy the property
  • Provide a copy to any prospective tenant within 28 days of a written request
  • Provide a copy to the local authority within 7 days of a written request
  • Where the report identifies remedial work required: complete the work within 28 days (or sooner if specified) and provide written confirmation to the tenant within 28 days of the original inspection

HMO (House in Multiple Occupation) properties have additional requirements under their licence conditions. Understanding EICR Observation Codes

C1

Danger Present

The installation presents an immediate risk of injury. The circuit or appliance should not be used until the fault is rectified. Your engineer may need to isolate the circuit on the day of inspection. Examples: exposed live conductors, absence of earthing on circuits with metal exposed parts, severely degraded wiring.

C2

Potentially Dangerous

Not immediately dangerous, but the installation has the potential to cause injury or start a fire if not addressed. For landlords: remedial works required within 28 days of the report date. Examples: RCD protection absent on bathroom circuits, circuits with significantly degraded insulation, incorrectly rated overcurrent protection.

C3

Improvement Recommended

An observation that does not require immediate action and does not cause the installation to fail (return an Unsatisfactory result). Examples: absence of supplementary bonding to old standard, lack of RCD protection on general circuits where not previously required.

FI

Further Investigation Required

An aspect of the installation cannot be fully assessed and requires further investigation before its condition can be determined. Common for concealed wiring or inaccessible areas. Does not necessarily indicate a fault but must be resolved before the EICR can be finalised.

Why NICEIC Registration Matters for EICRs

The Electrical Safety Standards Regulations 2020 require that EICRs are carried out by a "qualified person" with the technical knowledge and practical experience to carry out the inspection safely and competently, and to produce an accurate report.
