Legal Requirement
The Electrical Safety Standards in the Private Rented Sector (England) Regulations 2020 require all private landlords to have a valid EICR for every tenanted property, renewed at least every 5 years. Failure to comply risks fines of up to £30,000 per property.
Since the Electrical Safety Standards in the Private Rented Sector (England) Regulations 2020 came into force — for new tenancies from 1 July 2020, and all existing tenancies from 1 April 2021 — landlords in England are under a clear legal duty to maintain their electrical installations and to have them inspected by a qualified person at least every 5 years.
The Regulations require landlords to provide a copy of the EICR to their tenants within 28 days of the inspection, to new tenants before they move in, and to prospective tenants within 28 days of a written request. The local authority can require a copy within 7 days. Where the report identifies C1 or C2 observations, remedial works must be completed within 28 days and written confirmation provided to tenants.
